Online Shop Terms and Conditions

§1 Definitions

Seller – Katarzyna Sicińska, a natural person running the website https://www.fearlesskate.com/ in Poland. Contact with the Seller is possible via the contact form available on the website. The Seller is the administrator of the website and the service provider offering electronic services.

Shop – an online store operated as part of the FearlessKate website, enabling the purchase of digital products through the website.
Client – a natural person or entity making a purchase in the Shop.
Consumer – a Client who is a natural person making a purchase not directly related to business or professional activity.
Digital Product – digital content within the meaning of the Consumer Rights Act, in particular an e-book or other electronic file, delivered to the Client electronically without a physical medium after the conclusion of the Agreement.
Order – the Client’s declaration of intent directly aimed at concluding a Sales Agreement for a Digital Product.
Agreement – a distance sales agreement concluded between the Client and the Seller through the Shop.
Payment Operator – an external entity handling electronic payments in the Shop, which is not a party to the Agreement concluded between the Client and the Seller.

§2 General Provisions

The FearlessKate Shop sells digital products only delivered electronically and provides electronic services in accordance with applicable law. Sales are conducted globally, to Clients from around the world. The Shop operates in Polish and English. The Client makes a purchase in the selected language version. In case of discrepancies between language versions of the Terms and Conditions, the Polish version is binding.
The law governing agreements concluded via the Shop is Polish law, subject to mandatory provisions protecting Consumers.
Acceptance of these Terms and Conditions is a condition for placing an Order.

§3 Placing Orders and Concluding the Agreement

Orders are placed through the Shop website 24/7. The Client selects a Digital Product, adds it to the cart, fills in the order form, and makes payment.
At the moment of successful payment, the Sales Agreement is concluded. Confirmation of the Agreement is sent to the Client electronically to the provided e-mail address. Placing an Order obliges the Client to pay the price of the ordered Digital Product.

§4 Prices and Payments

Prices of Digital Products are given as final prices and are expressed in the currency indicated in the Shop, by default EUR.
The Seller provides electronic payments handled by an external Payment Operator.
The Seller does not collect Clients’ card data.
Payment is considered made at the moment of its authorization by the Payment Operator.

§5 Delivery of Digital Products

The Digital Product is delivered electronically by providing a download file or sending a link to the Client’s e-mail address.
Delivery occurs immediately after payment is credited.
In case of technical problems, the Client is obliged to contact the Seller via the contact form.

§6 License and Copyrights

Purchasing a Digital Product grants the Client a non-exclusive, non-transferable license to use the content for personal use only.
It is prohibited to copy, distribute, resell, share or publish the Digital Product without the Seller’s consent.
Products are protected by copyright law.

§7 Right of Withdrawal – Global Sale of Digital Products

All agreements concluded via the FearlessKate Shop, regardless of the Client’s country of residence, are subject to Polish law.
Digital products delivered electronically are not subject to return after the download has started, provided that the Client consented to immediate delivery and acknowledged the loss of the right of withdrawal before concluding the Agreement.
Once the Digital Product is made available, the Agreement is considered executed and a refund is not possible.
By placing an Order and making payment, the Client agrees to the immediate delivery of digital content and acknowledges the loss of the right of withdrawal.

§8 Complaints

The Seller undertakes to deliver the Digital Product in accordance with its description.
Complaints should be submitted electronically to the Seller’s e-mail address or via the contact form available on the website.
Complaints are processed within 14 days from receipt.

§9 Personal Data

The Seller is the administrator of Clients’ personal data.
Data is processed for the purpose of order fulfillment in accordance with applicable GDPR provisions.
Detailed information about data processing rules, Clients’ rights, and ways to contact the Administrator can be found in the Privacy Policy available on the FearlessKate website.

§10 Final Provisions

The Terms and Conditions are effective from the date of their publication on the FearlessKate website.
The Seller reserves the right to change the Terms and Conditions for important legal or organizational reasons, with Clients being informed electronically.
In matters not regulated by these Terms and Conditions, the provisions of Polish law apply.
